Allowed use of the ePIXfab MPW service is limited to research and prototyping purposes only and explicitly excludes any commercial use.

IMEC and CEA-LETI perform the MPW service on a reasonable business endeavour basis taking into account the actual status of knowledge in the scientific field concerned. The fact that IMEC or CEA-LETI perform design rules based checks on the your design does not imply that we guarantee correct performance of the resulting photonic ICs.

Therefore, IMEC and CEA-LETI disclaim any warranty regarding the correct and proper performance of the ICs resulting from the user's design, neither regarding to meet particular user requirements or the error-free operation of the IC.

We do provide design rules and necessary data on the standard processes. Secondly, we check your masks both manually and automatically, and give you feedback with respect to ease and chance of success for fabrication if you design 'difficult' features.

Prices are available upon request. The price given is always exclusive VAT

IMEC provides you with a quotation mentioning the price and terms of payment, and IMEC invoices you upon completion of the MPW shuttle.

All delivery times are standard reasonably estimated delivery times. IMEC and CEA-LETI make reasonable efforts to deliver on time. However, IMEC or LETI shall not be held liable for any delays or failure to meet delivery dates.. In case of any delay, IMEC or CEA-LETI shall, as soon as reasonably possible, notify you thereof in writing, stating whenever possible the time when delivery can be expected.

Shipping will be done DDU according to Incoterms 2000. The cost of this is included in our price. This means we pay for the transport and insurance of the wafer(s) until the package reaches the customer. Any import taxes are not included and need to be paid by the user.

The exchange of confidential information is regulated along the usual lines.

The user's design and the information submitted with the design is confidential information and will only be used for the implementation of the MPW service for that specific user. ePIXfab handles this with the appropriate care. The design is never disclosed to any third parties. Within IMEC and CEA-LETI the design is only disclosed on a reasonable kneed-to-know basis.

The design kit of IMEC or CEA-LETI shall be regarded as confidential information by the user. This includes that the design kit shall never be disclosed to third parties by the user.

In case CEA-LETI is the manufacturer, the user grants IMEC the right to disclose the design information to CEA-LETI.

The general rules concerning intellectual property in using the ePIXfab services are (in human language):

• Any design IP created by the user is owned by the user. IMEC or LETI do not gain any rights on this design IP.
• Any processing IP of the delivered wafer/chips is owned by IMEC or LETI. The user does not gain any rights on this processing IP.
• The user does not gain any rights on design IP owned by IMEC and/or LETI (e.g. which could be offered through a design kit) through the use of ePIXfab services.
• The user is responsible for the legal use of any design IP not owned by the user (owned by third parties). I.e. if a user uses design IP in its mask design which is owned by third parties, incl. IMEC and LETI, the user has to make sure he has payed the license fees or satisfies the according regulations. ePIXfab can never be held responsible for unlawful inclusion of design IP not owned by the user in a user's mask design.
• Cases of jointly generated IP between a user and IMEC and/or LETI can only arise in the context of contracts between a user and IMEC and/or LETI, e.g. bilateral R&D contracts, national and EU funded research project grants,... This does not affect the normal operation of ePIXfab access.

Whenever any publication is made by the User, relating to the MPW service or the resulting fabricated ICs, this shall always be accompanied by the following reference: “performed in the frame of ePIXfab set-up by IMEC vzw and CEA-LETI ”.

Publications of the results by IMEC or CEA-LETI shall have to be approved by the user prior to such publication.
